Schedule 1 Proposed Commonwealth regulation (Tobacco laws) section 2 1 Name This instrument is the Trans-Tasman Mutual Recognition Amendment (Tobacco Laws) Regulations 2026. 2 Commencement (1) Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. (a) subsections 45(3) and 47(6) of the Trans-Tasman Mutual Recognition Act 1997;

(b) subsection 185(1) of the Public Health (Tobacco and Other Products) Act 2023.

4 Schedules Legislation that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms. 5 Repeal of this instrument This instrument is repealed on the day after it commences. Schedule 1—Amendments Public Health (Tobacco and Other Products) Regulations 2024 1 Section 12 Repeal the section. Trans-Tasman Mutual Recognition Act 1997 2 Clause 3 of Schedule 2 (table item headed “Tobacco”) Repeal the item, substitute: Tobacco Public Health (Tobacco and Other Products) Act 2023 Trans-Tasman Mutual Recognition (Continuation of Temporary Exemption of Public Health (Tobacco and Other Products) Act 2023) Regulations 2025 3 The whole of the instrument Repeal the instrument.
